The National Association for Energy and Commerce (“NAEC,” “we,” “us,” or “our”), operating under our public brand, Power America Forward™, respects your privacy. This Privacy Notice explains what information we collect through our website at poweramericaforward.org (the “Site”), how we use and share that information, and the choices you have.

1. Information We Collect

Information you provide to us.

We collect the information you give us directly, such as when you subscribe to our newsletter, register for an event, request a conversation about membership or partnership, contact us, or otherwise interact with the Site. This may include your name, email address, telephone number, organization, title, and anything you include in your message.

Information we collect automatically.

When you visit the Site, we and our service providers may automatically collect certain information through cookies and similar technologies, such as your IP address, browser type, device information, the pages you view, and the dates and times of your visits. This helps us understand how the Site is used and improve it.

Information from other sources.

We may receive information about you from third parties, such as event partners or publicly available sources, consistent with applicable law.

2. How We Use Your Information

We use the information we collect to provide and administer our programs, events, research, and membership; to respond to your inquiries and communicate with you; to send newsletters, updates, and information about our work where permitted; to operate, maintain, and improve the Site; to understand and analyze how the Site is used; to protect the security and integrity of the Site; and to comply with our legal obligations.

3. Cookies and Similar Technologies

We use cookies and similar technologies to operate the Site, remember your preferences, and analyze traffic. You can usually set your browser to refuse or delete cookies, although some features of the Site may not work properly without them.

We currently use Squarespace's built-in website analytics to measure traffic and understand how the Site is used. We do not currently use third-party advertising or ad-tracking tools. If that changes, we will update this Notice to describe any additional analytics or advertising tools we use.

4. How We Share Your Information

We do not sell your personal information. We may share your information with service providers that perform functions on our behalf, such as email delivery, event registration, analytics, and website hosting, and that are obligated to protect it. We may also share information in connection with events or programs you register for, where relevant; when required by law or to respond to legal process; to protect the rights, safety, and property of NAEC and others; and in connection with a merger, reorganization, or transfer of our operations, consistent with this Notice.

5. Email and Text Message Communications

When you subscribe to our communications, you may unsubscribe at any time by using the link in our emails or by contacting us, and we will honor your request promptly. Certain administrative messages, such as messages about your membership or registration, are not promotional and may still be sent to you.

Text messaging. NAEC does not currently send text messages to Site visitors. If we introduce text messaging as a way to communicate with you in the future, we will only do so with your prior express consent, as required by the Telephone Consumer Protection Act (TCPA) and other applicable law. At that time, message and data rates may apply, message frequency may vary, and you will be able to opt out at any time by replying STOP or by contacting us using the information below. We will update this Notice with the full terms of any text messaging program before it begins.

6. Data Retention

We keep personal information for as long as it is necessary to fulfill the purposes described in this Notice, to meet our legal and operational needs, and to resolve disputes. After that, we delete or de-identify it.

7. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

Depending on where you live, you may have rights regarding your personal information, such as the right to request access to, correction of, or deletion of the information we hold about you, and the right to opt out of certain uses. To exercise these rights, please contact us using the information below, and we will respond consistently with applicable law.

Residents of Utah, California, and certain other states.

If you live in Utah, where NAEC is organized, or in California or another state with a comprehensive privacy law, you may have additional rights, including the right to know what personal information we collect, use, and disclose, the right to request deletion, and the right not to be treated differently for exercising your rights. This includes rights available under the Utah Consumer Privacy Act. NAEC does not sell personal information. To exercise these rights, please contact us using the information below.

9. Children's Privacy

The Site is intended for a professional and general adult audience, and it is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with information, please contact us and we will delete it.

11. Changes to This Notice

We may update this Privacy Notice from time to time. When we do, we will revise the effective date shown above and post the updated Notice on the Site. Your continued use of the Site after the changes take effect means that you accept the updated Notice.
